DPIA Assessment
Data Protection Impact Assessment methodology, risk evaluation, and GDPR Article 35 compliance.
1. DPIA Compliance Framework
Under Article 35 of the General Data Protection Regulation (GDPR), Data Protection Impact Assessments (DPIAs) are mandatory for processing operations that are likely to result in a high risk to the rights and freedoms of natural persons.
Opimatic conducts systematic DPIAs across our core software architecture—including our omnichannel conversational inbox, AI auto-posting engine, and automated customer data integrations—to ensure privacy-by-design and privacy-by-default at every stage of software development.
2. Assessment Triggers & Scope
Opimatic initiates a formal DPIA prior to launching or deploying any of the following technical changes:
- New Channel Integrations: Introducing major social media messaging APIs (e.g., WhatsApp Business, Meta Messenger, Instagram Graph API).
- AI & Machine Learning Deployments: Implementing automated natural language processing (NLP), smart auto-replies, or algorithmic content scheduling models.
- Large-Scale Data Processing: Systemic processing of high-volume communication metadata, user analytics, or multi-tenant database migrations.
- Architectural Overhauls: Substantial structural changes to primary database clusters, backup retention systems, or sub-processor infrastructure.
3. DPIA Assessment Methodology
Our assessment process follows a structured 5-step risk management lifecycle supervised by our Data Protection Officer (DPO):
- Step 1 (Context Description): Mapping data flows, storage locations, recipient categories, and processing purposes.
- Step 2 (Necessity & Proportionality): Evaluating whether processing is necessary and strictly proportional to stated business goals.
- Step 3 (Risk Identification): Identifying potential threats to data subject privacy (e.g., unauthorized access, data loss, algorithmic bias).
- Step 4 (Risk Mitigation): Designing technical, cryptographic, and procedural safeguards to reduce identified risks to acceptable residual levels.
- Step 5 (Approval & Review): Formal review and approval by our DPO and legal team, with mandatory annual re-evaluations.
4. High-Risk Processing Areas Evaluated
Our DPIA documentation specifically addresses key operational features within the Opimatic ecosystem:
- Unified Inbox & Automation: Evaluating the security of end-to-end messaging pipelines, WebSockets, and OAuth token storage.
- Automated AI Suggestions: Ensuring AI models operate on zero-retention API policies, prohibiting client data from being used for underlying LLM training.
- Cross-Border API Transfers: Analyzing data transmission vectors to foreign API providers (e.g., Meta, OpenAI, Twilio) under Standard Contractual Clauses (SCCs).
5. Risk Mitigation & Technical Controls
Where DPIAs identify inherent processing risks, Opimatic enforces mandatory technical controls to maintain low residual risk scores:
- AES-256 encryption at rest and TLS 1.3 encryption in transit for all messages and user tokens.
- Granular Role-Based Access Controls (RBAC) and mandatory multi-factor authentication (MFA) for agency and enterprise sub-accounts.
- Automated data retention and purging workers to prevent indefinite data storage.
6. Prior Consultation Protocols
If a DPIA indicates that processing would result in a high residual risk that cannot be sufficiently mitigated by available technical controls, Opimatic will consult the relevant Data Protection Supervisory Authority under GDPR Article 36 prior to initiating the processing operation.
7. Request DPIA Summaries & Verification
Enterprise clients and agency partners conducting vendor due-diligence may request executive summaries of our completed DPIAs or consult with our privacy team:
