Marketing Consent & Suppression
Our commitment to lawful communication, explicit opt-in standards, and instant suppression lists.
1. Marketing Consent Overview
Opimatic strictly adheres to global anti-spam laws, the GDPR, and the ePrivacy Directive regarding commercial electronic communications and promotional marketing. We believe that trusted business relationships begin with transparent, freely given, and unambiguous consent.
This policy outlines how marketing consent is gathered, recorded, managed, and permanently suppressed when users opt out across our platform and client campaigns.
2. Explicit Opt-In Standards
Under GDPR Article 6(1)(a) and Article 7, marketing consent must be active and verifiable. Opimatic enforces the following standards:
- No Pre-Ticked Boxes: Consent checkboxes on our registration forms, demo bookings, and lead capture widgets are never pre-checked.
- Granular Consent: Users can independently opt in to product updates, marketing newsletters, or promotional partner webinars without bundling terms.
- Clear Disclosure: Every signup form clearly specifies what communications the user will receive and links directly to our Privacy Policy.
3. Multi-Channel Communication Consent
Because Opimatic powers omnichannel workflows across SMS, and messaging platforms (such as WhatsApp, Facebook Messenger, and Instagram), consent parameters are channel-specific:
- SMS & WhatsApp Messaging: Strictly governed by telecommunication and Meta business messaging policies. Automated broadcasts are permitted only after an end-user initiates contact or explicitly opts in via keyword or web form.
4. Suppression List & Unsubscribe Automation
Respecting an individual's right to withdraw consent is instantaneous on our platform:
- One-Click Unsubscribe: All marketing emails include a visible, one-click unsubscribe link that takes effect immediately.
- Global Suppression: When a contact unsubscribes or requests suppression, their identifier is automatically added to our secure global suppression list, permanently blocking future marketing broadcasts across all campaigns.
- Transactional Exemption: Suppression lists apply exclusively to promotional marketing. Critical transactional notifications (such as password resets, security alerts, and billing receipts) remain active to ensure service continuity.
5. Agency & Sub-Account Compliance Rules
Clients utilizing Opimatic on agency plans to manage outbound campaigns for their own customers must comply with our Acceptable Use Policy regarding consent:
- Importing purchased, scraped, or rented email/phone lists into Opimatic is strictly prohibited.
- Agencies are solely responsible for ensuring that their imported leads have provided valid, verifiable opt-in consent prior to launching automated sequences.
6. Consent Audit Trails
To demonstrate compliance with regulatory accountability requirements (GDPR Article 5(2)), Opimatic automatically logs consent metadata, including:
- Timestamp of consent agreement.
- IP address and form identifier through which consent was captured.
